Pro Energy Services Group, LLC (“Pro Energy”) respects the privacy of our visitors to our website on which this policy is posted (“Site”).

Pro Energy may gather personal information from users of the Site. Pro Energy may analyze various mentioned personal information gathered from or about users to help Pro Energy better understand how the Site is used and how to make it better. By identifying patterns and trends in usage, Pro Energy is able to better design the Site to improve users’ experiences, both in terms of content and ease of use.

Pro Energy may also use your personal information for transactional purposes entered into with us, marketing and promotional purposes, security and fraud prevention, and legal requirements. We may also use your personal information for other purposes for which you have consented to, related to a purpose for which we collected it, and for which you would reasonably expect us to use your information for.

Service Providers   

Pro Energy will not, without your consent, share your personal information with third parties for their commercial purposes. Pro Energy may share your personal information with third parties which is necessary for them to perform duties for Pro Energy associated to Pro Energy’s own business purposes (“Service Providers”) subject to confidentiality and security requirements. Personal information shared is consistent with all applicable laws and regulations, and in accordance with this Privacy Policy.   

Compliance with Laws and Law Enforcement

 When we believe disclosure is appropriate, we may disclose your personal information to help investigate, prevent or take other action regarding illegal activity, suspected fraud or other wrongdoing; to protect and defend the rights, property or safety of Pro Energy, our users, our employees or others; to comply with applicable law or cooperate with law enforcement; to enforce our Terms and Conditions or other agreements or policies, in response to a subpoena or similar investigative demand, a court order or a request for cooperation from a law enforcement or other government agency; to establish or exercise our legal rights; to defend against legal claims; or as otherwise required by law. In such cases, we may raise or waive any legal objection or right available to us. We will notify you if permitted before undertaking such disclosures.

Corporate Transactions

Pro Energy reserves the right to transfer all information in its possession to a successor organization in the event of a merger, acquisition, or sale or transfer of some or all of Pro Energy’s assets.  However, the use and disclosure of all transferred information will be subject to this Privacy Policy. You will be given the opportunity to opt out of any such transfer if, in our discretion, it will result in the handling of your personal information that differs materially from this Privacy Policy.

  1. DO NOT TRACK

At this time, Pro Energy Site does not respond to do-not-tract (“DNT”) signals. Most web browsers and some mobile operating systems include a DNT feature or setting you can achieve to signal your privacy preference not to have data about your online browsing activities monitored and collected. We may use third-party companies to help provide our services and to help us understand the use of our Site. These third-party service providers may use certain information during your visit to the Site in order to provide advertisements about goods and services likely to be of interest to you. These companies typically use a cookie to collect this information. A “Cookie” is a string of information which assigns you a unique identification that a website stores on a user’s computer, and that the user’s browser provides to the website each time the user submits a query to the website. Pro Energy may use cookies to track the pages that users visit the Site, both to help Pro Energy improve users’ experiences and to assist Pro Energy understand how the Site is being used. A user of the Site can set their browser to refuse all cookies or to indicate when a cookie is being sent; however, certain features of the Site may not function properly without the aid of cookies.   

We may use Google Analytics to inform, optimize and serve ads based on your past activity on the Site. You can opt out of having your information collected and used by Google Analytics by visiting https://tools.google.com/dlpage/gaoptout/.   

  1. MANAGING YOUR INFORMATION PREFERENCES

You can opt out of receiving marketing e-mails from us by following the link provided at the bottom of all marketing e-mails you may receive from us. Certain e-mails cannot be opted out, such as e-mails about the status of your account.

Pro Energy takes the security of your personal information seriously and uses reasonable electronic, personnel and physical measures to protect it from loss, theft, alteration or misuse. However, please be advised that even the best security measures cannot fully eliminate all risks. As a result, while we strive to protect information transmitted on our Site and Services, we cannot guarantee that only authorized persons will view your personal information. We are not responsible for third-party circumvention of any privacy settings or security measures.

  1. CHILDREN

Pro Energy does not knowingly collect or maintain personal information from anyone under the age of 13. If we learn that personal information has been collected from a user under 13 years of age on or through the Site, then we will take the appropriate steps to cause this personal information to be deleted.

Pro Energy Site may contain links to other websites. These links are provided for informational purposes only.  A link to a third party’s website does not mean we endorse or that we are affiliated with it.  Pro Energy does not exercise control over third-party websites, and we make no representation as to the third-party website contents or its privacy policies. Accordingly, you should thoroughly review the privacy policy of a third-party website before disclosing any information to the website. In no event, shall Pro Energy be responsible for any third-party content, policies, or actions.

California Consumer Privacy Act (“CCPA”)

Under the CCPA, you have the right to:

Know: Request that Pro Energy disclose the categories and specific pieces of personal information that Pro Energy has collected about you.

Deletion: Request that Pro Energy delete any personal information that was collected about you, subject to certain exemptions.

Opt-Out: Request Pro Energy to not sell your personal information.

Non-Discrimination: Pro Energy cannot discriminate against you for exercising your rights under CCPA.   

“Shine the Light Law”

California Civil Code Section 1798.83, also known as the “Shine The Light” law, permits our users who are California residents to request and obtain from us, free of charge, information about the personal information (if any) we disclosed to third parties for direct marketing purposes in the preceding calendar year. If applicable, this personal information would include a list of the categories of the personal information that was shared and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year. Disputes over privacy issues contained in this Privacy Policy will be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. You also agree to abide by any limitation on damages contained in our Terms and Conditions, or other agreement that we have with you.

Pro Energy may, in its sole discretion, change this Privacy Policy from time to time. Any and all changes to Pro Energy’s Privacy Policy will be reflected on this page and the “Revised” date of the new version will be shown at the top of this Privacy Policy.  By continuing to use the Site or Services, you are consenting to this Privacy Policy.
